Terms of Service

Last updated: October 11, 2026

1. Acceptance of Terms

By accessing or using Clear Pool Command (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a binding agreement between you and Clear Pool Command.

2. Description of Service

Clear Pool Command is a software-as-a-service (SaaS) pool service management platform that helps pool service businesses manage customers, schedules, routes, service history, repairs, inventory, billing, and accounting. Features and functionality may be added, modified, or removed over time.

3. User Accounts and Registration

To access the Service, you must register for an account using accurate and complete information. You are responsible for safeguarding your password and for all activity occurring under your account. Notify us immediately of any unauthorized access. You must be at least 18 years old to create an account.

4. Subscription and Payment Terms

Paid subscriptions are billed in advance on a recurring basis (monthly or annually) at the rate disclosed at signup. Payments are processed by Stripe. You authorize us to charge your designated payment method for all fees. Subscriptions automatically renew unless canceled before the renewal date. Fees are non-refundable except where required by law.

5. Free Trial

New accounts are eligible for a 30-day free trial. Only one free trial is permitted per account, business, or billing entity. If you do not subscribe to a paid plan before the trial ends, your access to paid features will be suspended. We reserve the right to modify or terminate trial offers at any time.

6. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service or its data; (c) interfere with or disrupt the Service; (d) reverse engineer or copy any part of the Service; (e) use the Service to transmit malicious code or spam; or (f) resell or sublicense the Service without our written consent.

7. Data and Privacy

Our handling of personal data is governed by our Privacy Policy. You keep ownership of all customer data and business records you put in the Service. We process them only on your behalf to provide the Service, and we never sell them or use them for targeted advertising. Optional AI features send the related information to an AI provider to produce results. Phone-app permissions (camera, location, notifications) are used only for the features that need them.

8. Intellectual Property

The Service, including all software, branding, designs, and content provided by Clear Pool Command, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes during your subscription term.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAR POOL COMMAND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

You may cancel your subscription at any time through your account settings. We may suspend or end access for a violation of these Terms, non-payment, or as required by law. When access ends or is paused, your data stays saved and is not deleted automatically. You can export your customer data while you have access, and access returns when billing is resolved. Your data is deleted only when the account owner asks in writing at info@clearpoolcommand.com, except for records the law requires us to keep.

11. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Text Messaging Program

Program description. Pool service businesses that use Clear Pool Command (each a "Business") may send recurring operational text messages to customers who have expressly agreed to receive them. The Business is the sender and Clear Pool Command is its messaging software provider. Messages include appointment and technician arrival notices, service visit reports, quotes, invoices, payment receipts, account notices, and replies to customer questions.

How you opt in. You select an optional, unchecked Business Messaging choice in your secure customer portal, reached through normal portal sign-in or an email invitation. No permission request is sent by text. Consent is not a condition of purchasing goods or services.

Message frequency varies based on your service schedule and account activity. Message and data rates may apply.

Opt out. Reply STOP to any message to stop receiving texts. You will receive one confirmation and no further messages. To request messages again, use the optional choice in your secure customer portal.

Help. Reply HELP for help, or contact the Business directly or Clear Pool Command at info@clearpoolcommand.com.

Carriers are not liable for delayed or undelivered messages. Your mobile information is handled as described in our Privacy Policy; no mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Business Messaging acceptable use. Before its program is sent to the carriers, each Business must agree to text only customers who opted in themselves, never purchased or shared lists; to send only service and account messages, no marketing or prohibited content; to honor STOP right away; and that the Business is responsible for the messages it sends. If Clear Pool Command finds abuse, including spam, texting people who did not opt in, harassment, prohibited content, or anything that causes carrier complaints or fines, it may suspend or end the Business's messaging access without a refund of the monthly fee, setup fee or unused Message Credits. Clear Pool Command keeps a record of each agreement.

13. Tap to Pay

Tap to Pay lets a Business take contactless card and phone-wallet payments on its own phone, using the Clear Pool Command phone app only. Payments are processed by Stripe on the Business's own payment account; Clear Pool Command does not hold the funds.

Apple and Google requirements. On iPhone, the person taking payments must accept Apple's Tap to Pay on iPhone terms once on each device, and that acceptance is linked to their Apple Account. On Android, the phone must meet Google's and Stripe's device requirements (NFC, supported software, not rooted). These terms are between the user and Apple or Google.

Business responsibilities. The Business is responsible for honest use, for charging only amounts its customer agreed to, and for refunds and disputes. A card may be saved on file only with the customer's permission. Clear Pool Command may suspend Tap to Pay access for misuse or fraud.
